Per the FMCSA, “The Clearinghouse is a secure online database administered by the Federal Motor Carrier Safety Administration (FMCSA) that gives employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations.”
The Clearinghouse warehouses data on violations, including positive drug or alcohol test results along with test refusals. As drivers complete their return to duty processes and follow-up testing plans post violation, these details are added to their respective clearinghouse record
All drivers and DOT number holders are required to register in the Clearinghouse. To request a query on a driver, the driver must be registered so that they can give authorization for any queries to be done.
All employers are required to do annual queries on all their drivers as well as any new hires. Employers are also responsible for reporting any violations for a driver.
Failure to setup your registration and complete queries may result in fines up to $2,500 per offense per article 382.507 in Title 49 code of Federal Regulations.
